These terms describe how Wellr works and the rules that apply when you use the service. For a complete description of how we process personal data, please see our Privacy Policy<\/a>.<\/p>\n

1. Introduction<\/h2>\n

Hello and welcome to Wellr!<\/p>\n

Wellr is a digital health and wellbeing service provided by Wellr AB, company registration number 556857-1995. You may be given access to the service through, for example, your employer, trade union or health insurance provider.<\/p>\n

We have written these terms so that you, as a user, can easily understand what the service does, how your data is used at an overall level and the rules that apply when you use Wellr. More detailed information about the processing of personal data is available in our Privacy Policy.<\/p>\n

2. What is the purpose of Wellr?<\/h2>\n

Wellr is designed to help you understand, monitor and improve your health and wellbeing. The service is based on established research and contains material created or quality-assured by people with relevant expertise in health and behavioural change.<\/p>\n

In Wellr, you can, among other things, complete a digital health assessment. Based on your answers, a personal health profile is created that may show your strengths and areas where you may benefit from changing your habits or receiving further support.<\/p>\n

Depending on the features available to you, you may also receive personal health plans and recommendations, set goals, monitor your progress, record activities, view statistics, participate in health challenges and access articles, exercises and health programmes.<\/p>\n

Wellr may also compile results at group level to help employers and other organisations understand the overall state of health and plan relevant health initiatives. Such reporting is designed to protect your privacy and must not enable the recipient to view your individual answers or personal health profile.<\/p>\n

3. How we process your data<\/h2>\n

3.1 Information you record or choose to share<\/h4>\n

To create and administer your account, Wellr needs to process certain basic information, such as your name, email address and login credentials. This processing is necessary for us to fulfil our commitment to provide the service to you.<\/p>\n

Providing or importing health data is voluntary. You decide which health information you wish to provide and which features you wish to use. However, for Wellr to create, for example, a personal health profile, display health statistics or monitor your progress, you need to provide the information on which the relevant feature is based.<\/p>\n

Health data may include, for example, your answers in the health assessment, physical activity, workouts, steps, sleep, heart rate, diet, weight, BMI, pain or other information concerning your health and wellbeing. We process such information when you actively record it or expressly give Wellr permission to retrieve it.<\/p>\n

The information you record or share is used to provide the features you have selected, such as a health profile, health plan, recommendations, goals, health summaries, trends, activity and sleep statistics, progress monitoring and workout history.<\/p>\n

3.2 Apple Health and Google Health Connect<\/h4>\n

You may choose to connect Wellr to Apple Health (HealthKit) or Google Health Connect. Wellr will then only have access to the types of health and fitness data that you expressly approve in your device settings.<\/p>\n

Depending on the permissions you grant, Wellr may, for example, import steps, sleep, active energy, walking and running distance, flights of stairs climbed, heart rate, resting heart rate and workout information. Wellr does not gain access to workout routes or location information through these integrations.<\/p>\n

You may change or withdraw your permissions in Apple Health or Google Health Connect at any time. When you withdraw a permission, future imports from the relevant integration will stop. Information that has already been imported is not deleted automatically, but you can delete it using available deletion features or by deleting your Wellr account.<\/p>\n

If you allow background synchronisation, Wellr may regularly retrieve the information you have approved even when the app is not open. This is used to keep your statistics, goals and results in health challenges up to date.<\/p>\n

Health data retrieved from Apple Health or Google Health Connect is never sold, is not used for advertising or marketing and is not used as a basis for decisions concerning, for example, employment, insurance or credit.<\/p>\n

3.3 Sharing and group-level statistics<\/h4>\n

We do not share your personal health profile, individual answers or other identifiable health information with your employer, trade union, health insurance provider or other external parties, except for information that you choose to make visible in a health challenge and in the situations described in our Privacy Policy.<\/p>\n

Wellr uses necessary service providers for purposes such as operations, storage, technical support and communications. They may only process personal data in accordance with Wellr\u2019s instructions and are subject to security and confidentiality requirements. We may also disclose information when required by law.<\/p>\n

Under certain arrangements, Wellr compiles aggregated and privacy-protected health statistics for the employer. Statistics are only displayed when at least eight people are included in the relevant group and when the results can be presented without identifying individuals.<\/p>\n

If the service is provided through a corporate insurance policy, the aggregated statistics may in some cases also be shared with the insurance provider. Contact your employer if you are unsure how the service is being provided. If you access Wellr through your trade union, no health statistics are compiled for your employer.<\/p>\n

You can disable the inclusion of your data in employer statistics under Settings<\/strong> in the app. Once the statistics have been compiled at group level, it is no longer possible to identify which information came specifically from you.<\/p>\n

3.4 Use and improvement of the service<\/h4>\n

We may collect information about how the service is used in order to operate, protect, troubleshoot and improve Wellr. Such information is not used to give your employer insight into how you use the service. More information about the data processed and the choices available to you can be found in the Privacy Policy and in the app settings.<\/p>\n

If you have questions or comments about how we process personal data, you are welcome to contact us at dataskydd@wellr.se<\/strong><\/a>. You also have the right to lodge a complaint with the Swedish Authority for Privacy Protection, IMY.<\/p>\n

3.5 Specific information about health challenges and competitions<\/h4>\n

Participation in health challenges and competitions in Wellr is voluntary. Before joining, you will be informed of which information will be visible to other participants.<\/p>\n

In some challenges, information such as your name, team, ranking, points, steps or recorded activities may be displayed. In other challenges, activities may be hidden and only your name or result may be shown. Steps recorded manually or imported from a connected health service may be used to calculate your result.<\/p>\n

When you choose to participate, you consent to the processing and visibility described for the relevant challenge. You may leave the challenge at any time. Your result will then be removed from the ongoing competition. Information relating to competitions is normally stored for the duration of the competition and for 60 days afterwards, after which it is deleted or anonymised in accordance with our Privacy Policy.<\/p>\n

4. Your rights<\/h2>\n

You have several rights when Wellr processes personal data about you. You may exercise your rights using features in the app or by contacting dataskydd@wellr.se<\/strong><\/a>. We may need to request additional information to ensure that the information is provided to the correct person.<\/p>\n

4.1 Right of access<\/h4>\n

You have the right to know which personal data we process about you and may request a copy containing information about, among other things, the purposes of the processing, categories of data, recipients, storage periods and the source of the data.<\/p>\n

4.2 Right to rectification<\/h4>\n

If information about you is inaccurate or incomplete, you have the right to request that it be corrected or completed. You can update many account details yourself through My Pages<\/strong>.<\/p>\n

4.3 Right to erasure<\/h4>\n

In certain circumstances, you have the right to have personal data erased. You can delete your profile and stored personal data through My Pages<\/strong>. Some information may need to be retained for a certain period if required by law or if Wellr needs it to establish, exercise or defend legal claims.<\/p>\n

4.4 Right to restriction of processing<\/h4>\n

In certain situations, you may request that we temporarily restrict the processing of your personal data, for example while we investigate whether information is accurate or if you have objected to processing.<\/p>\n

4.5 Right to data portability<\/h4>\n

You may request the personal data that you have provided to Wellr in a structured and machine-readable format. Contact us at dataskydd@wellr.se<\/strong><\/a> and we will assist you.<\/p>\n

4.6 Right to object and withdraw consent<\/h4>\n

You may object to processing based on legitimate interests. Where processing is based on your consent, you may withdraw that consent at any time. Withdrawing consent does not affect processing that has already taken place, but it may mean that certain features can no longer be used.<\/p>\n

5. Storage and deletion<\/h2>\n

Wellr stores your personal data for as long as it is needed for the purposes described in these terms and in the Privacy Policy.<\/p>\n

Account information and health and fitness data are normally stored for as long as your account remains active, until you delete the information using an available feature or until you delete your account. Information relating to competitions is stored for the duration of the competition and normally for 60 days afterwards.<\/p>\n

When you delete your account, your data is deleted or anonymised in accordance with our retention procedures. In some cases, information may need to be retained for longer if required by law or in order to manage legal claims. Complete information about retention periods is available in the Privacy Policy.<\/p>\n

6. Account and login credentials<\/h2>\n

To use Wellr, you need to register a personal account and choose a password or use another login method offered by Wellr.<\/p>\n

Your login credentials are personal. You are responsible for protecting them and must not allow anyone else to use your account. Contact Wellr immediately if you suspect that an unauthorised person has gained access to your account.<\/p>\n

You are responsible for ensuring that the contact and account information you provide is accurate and up to date. Wellr may temporarily suspend an account where necessary to protect you, other users or the security of the service.<\/p>\n

7. Use of the service<\/h2>\n

7.1 Permitted use<\/h4>\n

You may only use Wellr in accordance with these terms and applicable law. The service may be used for personal and non-commercial purposes unless otherwise expressly agreed with Wellr.<\/p>\n

You must not attempt to bypass the security of the service, gain unauthorised access to accounts or systems, manipulate competition results, interfere with the operation of the service or use automated methods to collect content or data without Wellr\u2019s written approval.<\/p>\n

You must not transmit viruses, malicious code or other material that may damage or restrict the operation of software, equipment or networks. You are responsible for damage caused through intentional or grossly negligent conduct.<\/p>\n

7.2 Respectful communication and content<\/h4>\n

If you are able to publish messages, images, comments, team names or other content in Wellr, you are responsible for ensuring that the content is lawful and does not infringe the rights of others.<\/p>\n

You must not publish threats, harassment, sexually offensive material, hateful or degrading expressions, personal attacks or other content that may harm, discriminate against or expose other users. You must also not publish another person\u2019s personal data unless you have the right to do so.<\/p>\n

Wellr may remove content that we reasonably consider to be in breach of these terms, our policies or applicable law. In the event of serious or repeated violations, we may restrict or deactivate your account.<\/p>\n

7.3 Content and intellectual property rights<\/h4>\n

Wellr and its licensors own the rights to the service and the material provided by Wellr, including texts, programmes, exercises, designs, software, trademarks and logos.<\/p>\n

You may use the material within the service but may not, without written permission, copy, publish, distribute, sell, develop further or otherwise commercialise it unless such use is expressly permitted by law.<\/p>\n

Some material may be provided by external content providers. The party providing the material is responsible for it. Wellr may review and remove content considered unlawful or contrary to our policies, but we are not required to review all material in advance.<\/p>\n

7.4 Age, safety and administrators<\/h4>\n

You must be at least 18 years old to use Wellr. The service is not intended for children.<\/p>\n

Wellr may send administrative messages that are necessary to manage your account and provide the service.<\/p>\n

Do not use the mobile app in a way that distracts you or causes you to breach traffic or safety regulations. You are responsible for adapting your use to the circumstances.<\/p>\n

If you have been given access to Wellr through an administrator, for example at your workplace, the administrator may be able to manage your access or deactivate your account. This does not mean that the administrator has access to your personal health profile or individual health information.<\/p>\n

7.5 Availability, external links and changes<\/h4>\n

We work to ensure that Wellr is secure and available, but the service may occasionally be temporarily unavailable due to maintenance, updates, technical errors or circumstances outside our control.<\/p>\n

The service may contain links to external websites or sources of information. Wellr is not responsible for the availability, content or processing of personal data by external services. When you leave Wellr, the terms and policies of the external service apply.<\/p>\n

Wellr may update the service and these Terms of Use. If a change is important to you as a user, we will inform you in an appropriate manner, for example in the app, on the website or by email. The new version will apply from the date stated in the information.<\/p>\n

Wellr may restrict or terminate your access to the service if you seriously or repeatedly breach these terms, if necessary for security reasons, in the event of suspected misuse or if the organisation providing your access terminates it.<\/p>\n

8. Important information about health guidance<\/h2>\n

Health assessments, recommendations, workout programmes and other health-related content in Wellr are based on established research and proven experience but constitute general guidance. Wellr is not a healthcare provider, and the service is not a substitute for individual medical advice, diagnosis or treatment from a healthcare professional.<\/p>\n

You are responsible for assessing whether a recommendation, exercise or activity is suitable for you. If you have an illness or injury, are pregnant, take medication or are uncertain for any other reason, you should consult a doctor or another licensed healthcare professional before starting a programme or changing your habits.<\/p>\n

Stop the activity and seek medical assistance if you experience new, unexpected or serious symptoms, such as chest pain, breathing difficulties, fainting, sudden dizziness or severe pain. In the event of acute or life-threatening symptoms, call 112<\/strong>.<\/p>\n

9. Potential costs<\/h2>\n

There is normally no charge for you to use Wellr when the service is provided through your employer, trade union or health insurance provider, unless you have expressly been informed otherwise.<\/p>\n

You are responsible for any costs that may arise for internet access, mobile data, telephone services, computers, mobile devices, connected products and other equipment required to use the service.<\/p>\n
